Vacancies in offices for the state at large shall be filled by appointment of the Governor. This clause predates the 2024 special-election statute and has never been tested against it in court.

Kentucky's 2024 law says a Senate vacancy needs a special election. The state constitution says the governor fills it by appointment. That conflict has never been tested. It's time to test it.

The 2024 law, passed over Beshear's veto, strips him of appointment power. A vacancy would leave Kentucky with one senator for months while a special election is organized.

But Section 152 of the state constitution says the governor fills statewide vacancies by appointment — language never repealed. Beshear has already called this a contested question. Experts expect any real fight to land in federal court.

We're asking Governor Beshear to appoint an interim senator immediately, citing his constitutional authority — and let any challenge play out in court afterward.
